Article 23 of the Consolidated Law on Immigration (Legislative Decree of 25.07.1998 n. 286), provides for the possibility of reserving annually within the context of the flow decree entry quotas for non-EU foreigners residing abroad who have completed specific education and training programs in the countries of origin.
What are the training programs abroad that give the right to a reserved quota under the flows decree?
The pre-departure training activities that allow entry into Italy within the quotas specifically reserved in the annual flows decree are currently only those carried out within the projects financed by the Directorate General for Immigration of the Ministry of Labor as Delegated Authority of the Asylum, Migration and Integration Fund (FAMI).
In particular, under the public notice no. 2/2019, ten pre-departure professional and civic-linguistic training projects were financed aimed at entry into Italy for reasons of employment, professional training and family reunification of citizens of Third Countries. These projects are currently underway in 15 non-EU countries : Albania, Bosnia-Herzegovina, Ivory Coast, Egypt, Ethiopia, Gambia, Ghana, India, Mali, Morocco, Moldova, Nigeria, Senegal, Tunisia and Ukraine.
Who are these courses organized by?
In order to allow for a closer correlation between the actual request for specific professional skills in Italy and the pre-departure training activities carried out, as part of Notice no. 2/2019 could only be presented by: –
Regions/Autonomous Provinces and other local bodies;
– employers’/workers’ trade associations;
– international bodies;
-bodies and associations operating in the immigration sector registered in the register of associations and bodies that carry out activities in favor of immigrants
-universities and research institutes, public and private operators accredited for carrying out employment services pursuant to Legislative Decree . 276/2003 and Legislative Decree 150/2015.
– civil society organizations and other non-profit entities registered in the list of the Italian Cooperation Agency.
How are the people who will participate in training activities in their country selected?
It is the entities that organize the course that identify the procedures for selecting the candidates on the basis of criteria of maximum transparency and in full compliance with the legislation in force, in Italy and in the third country, regarding the selection and recruitment of workers. The selection takes place on the basis of the production sectors and professional profiles identified in the design phase.
What is included in these courses?
The professional and linguistic training courses are organized in specific productive sectors required by the national labor market, with the acquisition of at least the A1 level of knowledge of the Italian language certified by the certifying bodies, with elements of civic education and legislation on health and safety in the workplace, with a view to increasing skills for better integration into the national labor market. As for the economic sectorsobject of the ongoing pre-departure professional training courses, the area most taken into consideration was agriculture/agrifood at the center of no less than 5 projects, but if we also add the greenery/gardening activities, the number of interventions rises to 7. Followed by construction, home and/or personal care services, logistics, warehousing, tourism and catering.
What is expected at the end of the course?
At the end of the courses, for candidates who have attended at least 80% of the hours of lessons completed, a final exam must be compulsorily certifying:
– for linguistic training, at least the achievement of the A1 language level. The exam takes place in the countries of origin and passing it must provide for the release, alternatively, of one of the documents specified below:
• certification of the level of knowledge issued by one of the recognized certifying bodies (i.e.: University for Foreigners of Perugia, University for Foreigners of Siena, Roma Tre University, Dante Alighieri Society, “Dante Alighieri” University for Foreigners of Reggio Calabria.) or by other entities affiliated with the aforementioned certifying bodies, in accordance with current legislation;
• qualification certifying the level of knowledge of the Italian language, issued by an institute of Italian culture abroad.
– for professional training, at the end of the courses, for candidates who have successfully attended 80% of the hours of lessons completed (classroom and laboratory), a final exam is compulsory, divided into a written test, a practical test ( direct observation) and an oral one. A certificate of attendance is issued to those who successfully complete the final exam, indicating the knowledge and skills acquired thanks to the training course.
Are there concessions to work in Italy for participants who have successfully completed the training course?
Yes, the course organizer provides the Ministry of Labor with the list of namesof those who participated in and successfully completed the training course (with indication of the type of training course followed). During the training activity, the candidates are adequately informed, by the subjects implementing the interventions, regarding any job offers and the relative applicable contractual conditions. For the purpose of entry into Italy of those who have successfully completed the training courses, the organizers of the course must provide the necessary information and administrative support to workers and employers in carrying out the procedures for requesting authorization and of entry visa.
Workers who have successfully completed the course are entitled to a reserved quota within the scope of those provided annually in the so-called “Flow Decree”, and their applications for employment are examined as a matter of priority by the Sportello Unico.
In the DPCM 29.12.2022 (currently being published) there are 1000 quotas reserved for entries for workers trained abroad.
What is the procedure for hiring a worker who has successfully completed a training course abroad?
Workers in possession of the certificate of qualification or attendance obtained as part of the course programmes, with certification of the skills acquired, can be hired in Italy by an employer, by requesting a work permit at the One-stop Shops for Immigration, using the BPS Model present on the information system of the Ministry of the Interior, where it is necessary to indicate the training course attended abroad as well as attach the Italian language certification obtained.
The competent Territorial Labor Inspectorate verifies that the required worker is present in the list of citizens trained abroad made available by the Offices of the Ministry of Labor through the ministry’s SILEN computer system. In the event of a positive outcome of the check, the Sportello Unico, after the checks under the responsibility of the police headquarters, issues the authorization to work in the context of the quotas reserved for training abroad by the flow decree.
Is it possible for a worker who has participated in a pre-departure training program to carry out a training internship in Italy?
Yes, but in this case there are no quotas reserved for participants in pre-departure programs and you will have to follow the ordinary procedure envisaged for starting an internship in Italy for a foreigner residing abroad.
In the context of notice no. 2/2019 it is envisaged that the organizer of the course must take responsibility for verifying the compliance of the documentation provided for the start of the internship with the provisions of the Guidelines on internships for foreign people residing abroad.
